CLAY COUNTY — State Representative Darren Bailey announced Friday that he has asked an appellate court to vacate the restraining order he won this week against Illinois’ stay-at-home order.

Bailey’s attorney has reportedly told the appellate court he consented to lifting the order entered earlier this week in Clay County Circuit Court.

Illinois Attorney General Kwame Raoul filed an appeal on the ruling directly to the Illinois Supreme Court.

The High Court accepted the motion to directly appeal a Clay County judge’s ruling temporarily exempting the state representative from the governor’s stay-at-home order.

The decision doesn’t mean the Supreme Court will hear the case. It could decline and send the case back to the fifth circuit appellate court.
